Overview
These Terms of Service ("Terms") govern the relationship between Conscious Clicks ("we", "us", "our") and any individual or entity ("you", "Client") who purchases or enquires about our services. By booking an audit or engaging with our services, you agree to be bound by these Terms.
Conscious Clicks is a New Zealand-based consultancy that audits how accommodation properties appear within AI recommendation engines, including ChatGPT, Claude, Gemini, and Perplexity. We provide analysis, written reports, and strategic guidance — not implementation services, unless separately agreed in writing.
Services
Our core offering is the AI Visibility Audit, a fixed-price, one-time engagement that includes:
- A 15-minute intake call to understand your property and target guest profile
- Analysis of how your property appears across four major AI engines
- Review of your website structure, schema markup, OTA listings, and Google Business Profile
- Assessment of review patterns and third-party authority signals
- A written report detailing findings, prioritised recommendations, and a suggested implementation roadmap
- A 30-minute walkthrough call to discuss the report
Any services beyond this scope — including ongoing retainer work, implementation support, or additional research — require a separate written agreement.
We reserve the right to decline any engagement at our discretion, including where we believe the audit is unlikely to provide meaningful value to the Client.
Payment & Pricing
The current price for one AI Visibility Audit is $750 NZD, inclusive of GST where applicable. This price is fixed and covers a single property. Multi-property pricing is available on request.
Payment is required in full before work commences. We will issue an invoice following your initial enquiry. Work will not begin until payment has been received and cleared.
All prices are listed in New Zealand Dollars (NZD). If you are purchasing from outside New Zealand, you are responsible for any currency conversion fees charged by your bank or payment provider.
Delivery & Timeline
We aim to deliver your completed audit report within seven (7) business days of the intake call, subject to the call being completed and payment having cleared.
The written report will be delivered electronically, typically as a PDF to the email address provided at the time of booking. The walkthrough call will be scheduled at a mutually convenient time following delivery of the report.
Timeline estimates are provided in good faith and are not a guarantee. Delays caused by factors outside our control — including your unavailability for the intake call — may affect the delivery date.
Refunds & Cancellations
Because our work is custom, time-bound, and begins immediately after your intake call, our refund policy is limited:
- Before the intake call: A full refund will be issued if you cancel before the scheduled intake call, provided we receive notice at least 24 hours in advance.
- After the intake call: No refund is available once the intake call has been completed and work has commenced.
- Delivery issues: If we fail to deliver the report within 14 business days of the intake call through our own fault, you may request a full refund.
Refunds, where applicable, will be processed within 5 business days to the original payment method.
Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986 (New Zealand).
Intellectual Property
Upon receipt of payment in full, we grant you a non-exclusive, perpetual licence to use the audit report and its recommendations for your own internal business purposes.
You may share the report with staff, contractors, or consultants working on your behalf. You may not resell, sublicence, or publicly redistribute the report or its contents without our prior written consent.
All methodologies, frameworks, templates, and processes used to produce the audit remain the intellectual property of Conscious Clicks. The report you receive is a deliverable — not a transfer of the underlying method.
Confidentiality
We do not require access to your private accounts or login credentials. All analysis is conducted using publicly available information: your website, OTA listings, Google Business Profile, and publicly visible reviews.
Any information you voluntarily share with us during the intake call — including occupancy rates, booking mix, or commercial context — will be treated as confidential and used solely for the purpose of producing your audit. We will not share this information with third parties.
We may use anonymised, aggregated insights from completed audits (e.g. industry-level patterns in AI visibility) for our own research and marketing purposes, without identifying your property.
Limitation of Liability
To the fullest extent permitted by applicable law, Conscious Clicks' total liability to you in connection with any audit or service is limited to the amount paid for that engagement.
We are not liable for any indirect, consequential, incidental, or special losses, including but not limited to loss of bookings, loss of revenue, or loss of business opportunity, arising from your use of or reliance on our reports or recommendations.
This limitation does not apply to liability arising from our fraud, wilful misconduct, or any liability that cannot be excluded under New Zealand law, including the Consumer Guarantees Act 1993.
No Guaranteed Results
AI recommendation engines are operated by third parties over which we have no control. Their algorithms, ranking signals, and content policies change frequently and without notice.
Our audit reflects the state of AI visibility signals at the time the analysis is conducted. We make no warranty, express or implied, that implementing our recommendations will result in your property being recommended by any particular AI engine, or that any improvement in visibility will translate into additional bookings.
The bookings modelling included in your report is illustrative only. It is based on reasonable assumptions and is not a forecast or guarantee of commercial outcomes.
Governing Law
These Terms are governed by the laws of New Zealand. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the New Zealand courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
We reserve the right to update these Terms from time to time. The version in effect at the time of your booking governs your engagement. Material changes will be communicated via our website.
